Building Rules and Regulations:
- The sidewalks, halls, passages exits, entrances, stairways and elevators (if any) of the Shopping Center shall not be obstructed by any of the tenants or used by them for any purpose other than for ingress to and egress from their respective premises. The halls, passages, exits, entrances, elevators and stairways are not for the general public, and Landlord shall, in all cases, retain the right to control and prevent access thereto of all persons whose presence in the judgment of Landlord would be of any persons whose presence in the judgment of Landlord would be prejudicial to the safety, character, reputation, and interests of the Shopping Center and its tenants, provided that nothing herein contained shall be constructed to prevent such access to persons with whom any tenant normally deals in the ordinary course of its business, unless such persons are engaged in illegal activities. Except with the prior written consent of Landlord, no tenant or any employee or invitee of any tenant shall go upon the roof of the Shopping Center unless accompanied by an employee of Landlord.
- Except with the prior written consent of Landlord, no sign, picture, name, advertisement or notice visible from the exterior of any tenants premises shall be inscribed, painted, affixed or otherwise displayed by any tenant on any part of the Shopping. Landlord will adopt and furnish to each tenant general guidelines relating to signs inside the Shopping Center on the sales floor. Tenant agrees to conform to such guidelines, but may request approval of Landlord for modifications. All approved signs or lettering on doors shall be printed, painted or inscribed at the expense of tenant. Material visible from outside the Shopping Center will not be permitted.
- No tenant shall use or permits its premises to be used for lodging or the storage of merchandise (other than normal inventory) held for sale to the public, and unless ancillary to a restaurant or other food service use specifically authorized in the lease of a particular tenant, no cooking shall be done or permitted by an tenant on the premises, except that the preparation of coffee, tea, hot chocolate, similar items and microwaved food for tenants and their employee shall be permitted.
- Landlord will furnish each tenant with two keys free of charge. Landlord may make reasonable charge for any additional keys. No tenant shall alter any lock or install a new or additional lock or any bolt on any exterior door of its premises without the prior consent of Landlord. Each tenant shall, in each case, furnish Landlord with a key for any such lock. Each tenant, upon the termination of its tenancy, shall deliver to Landlord all keys to doors in the Shopping Center which shall have been furnished to tenant. Each tenant shall see that the doors of its premises are closed and securely locked at all times as tenants employees leave the premises.
- No tenant shall use or keep in the premises or in any other part of the Shopping Center any kerosene, gasoline or inflammable or combustible fluid or material except such materials that are customarily used in the operation or cleaning of the premises, and then only in accordance with all applicable laws, ordinances and recognized safety procedures. No tenant shall use any method of heating or air conditioning except as provided by Landlord. No tenant shall use, keep or permit to be used or kept any foreign or noxious gas or substance in the premises, or, except with the prior written consent of Landlord, permit or suffer the premises to be occupied or used in a manner offensive or objectionable to Landlord or other occupants of the Shopping Center by reason of noise, odors or vibration, or interfere in any way with other tenants or those having business therein.
- In case the invasion, mob, riot, public excitement or other similar circumstances rendering such action advisable in Landlords reasonable opinion, Landlord reserves the right to prevent access to the Shopping Center during the continuance of the same by such an action as Landlord may deem appropriate, including closing entrances to the Shopping Center.
- The toilet rooms, toilets, urinals, wash bowls and other apparatus shall not be used for any purpose other than that for which they were constructed. No foreign substances of any kind whatsoever shall be throw therein. The expense of any breakage, stoppage or damage resulting from the violation of this rule shall be borne by the tenant who, or whose employees or invitees, shall have caused it.
- Except with the prior written consent of Landlord, no tenant shall sell or permit the sale in the premises or use or permit the use of common area for the sale of newspapers, magazines, periodicals, tickets to entertainment event or any other goods, merchandise or service. No tenant shall carry on, or permit or allow any employee or other person to carry on, the business of stenography, typewriting or any similar business in or from the premises for the service or accommodation of occupants of any other portion of the Shopping Center, nor shall the premises of any tenant be used for manufacturing of any kind, or any business or activity other than specifically provided for in such tenants lease.
- Except with the prior written consent of Landlord, no tenant shall use any advertising media which may be heard outside of the premises or place or permit the placement of any radio or television antenna, loudspeaker, sound amplifier, phonograph, searchlight, flashing light or other device of any nature on the roof or outside the boundaries of the premises (except for a tenants approved identification sign or signs) or at any place where the same may be seen or heard outside of the premises.
- Except with prior written consent of Landlord, all loading and unloading of merchandise, supplies, materials, garbage and refuse shall be made only through such entryways and elevator (if any) and at such times as Landlord shall designate. In its use of the loading areas, each tenant shall not obstruct or permit the obstruction of said loading area, and at no time shall park or allow its officers, agents or employees to park vehicles therein except for loading and unloading.
- The directory of the Shopping Center, if any, will be provided for the display of the name and location of tenants, and Landlord reserves the right to exclude any other names therefrom. An additional name which any tenant shall desire to place upon said bulletin board must first be approved by Landlord, and, if so approved, a charge will be made therefor.
- Except with the prior written consent of Landlord, no curtains, draperies, blinds, shutters, shades, screens or other coverings, hangings or decorations shall be attached to, hung or place in, or used in connection with, any window of the Shopping Center without the prior written consent of Landlord.
- Each tenant shall see that the doors of its premises are closed and locked and that all water faucets, water apparatus and utilities are shut off before such tenant or its employees leave the premises, so as to prevent waste or damage.
- No tenant shall use any portion of the common area for any purpose when the premises of such tenant are not open for business or conducting work in preparation therefor.
- No use shall be made of the Shopping Center or any portion or portions thereof that would (i) violate any law, ordinance or regulation, (ii) constitute nuisance, (iii) constitute a hazardous use, or (iv) void any policy or policies of insurance.
- All trash, refuse and waste material shall be regularly removed from the Premises of each occupant and until removal shall be stored (i) in adequate containers, which shall be located so as not to be visible to the general public shopping in the Center, and (ii) so as not to constitute any health or fire hazard or nuisance to any occupant.
- Landlord may, in its reasonable discretion, waive any one or more of these Rules and Regulations for the benefit of any particular tenant or tenants, but no such waiver by Landlord shall be construed as a waiver of such Rules and regulations in favor of any other tenant or tenants, nor prevent Landlord from thereafter enforcing any such Rules and Regulations against any or all of the tenants of the Shopping Center.
- These Rules and Regulations are in addition to and shall not be construed, in any way, to modify, alter or amend, in whole or in part, the terms, covenants, agreements and conditions of any lease of premises in the Shopping Center. For purposes of these Rules and Regulations, the prior written consent of Landlord shall include without limitation, a provision contained in the written lease agreement of a particular tenant.
- Landlord reserves the right to make such other and reasonable rules and regulations a in its judgment may from time to time be needed for the safety, care and cleanliness of the Shopping Center and for the preservation of good order therein.
